Tomorrow, arguments will be heard in the case of Texas v. US which is the court case which challenges the constitutionality of the Affordable Care Act (ACA) since the individual mandate penalty was eliminated. Previously, the Supreme Court had held that the ACA was constitutional under the taxing authority given to Congress. As there was no longer a tax, some states are arguing that the ACA no longer passes the constitutional test which the Supreme Court had previously used. Back in December, a federal judge in Texas agreed with the states and ruled that the ACA was unconstitutional. Other states which are supporting the ACA, filed an appeal to the Fifth Circuit and the argument to the Fifth Circuit will be heard tomorrow.
