Yesterday, a federal court in Texas release an opinion which invalidates portions of the Affordable Care Act (ACA). The case of Braidwood Management v. Becerra addresses the ACA’s provisions related to preventive services. The specifics of the case focus on the fact that the ACA requires coverage at no cost to covered individuals for services which receive an A or B level recommendation by the US Preventive Services Task Force. Back when the judge heard the case, the Kaiser Family Foundation wrote an explainer about the case which gets into all the legal theories.
AAHD will continue to monitor this case as it will likely be appealed.
