Yesterday, the Trump Administration announced new guidance on Section 1332 of the Affordable Care Act which would provide states with the opportunity to make changes to marketplaces in their own states. Presumably, this new guidance could allow states to bypass some of the protections built into the ACA. It remains to be seen how states will try to use the new guidance and any changes would need to go through an approval process with CMS, meaning it would not affect marketplace plans until probably 2020.
